We are J. Dauman Finance Limited, a company registered with Companies House under number 05444949, operating at Ealing Cross, 1st Floor, 85 Uxbridge Road, London W5 5TH. Our Data Protection Officer is Marta Kłosińska, who can be contacted at office@jdauman.com.

This privacy notice has been prepared to keep you and your company informed of how J. Dauman Finance handles your personal data, and to confirm that all such handling is carried out in compliance with UK GDPR and the Data Protection Act 2018 ("Data Protection Legislation").

The terms "Personal Data," "Special Categories of Personal Data," "Personal Data Breach," "Data Protection Officer," "Data Controller," "Data Processor," "Data Subject," and "process" shall have the meanings given to them in the Data Protection Legislation. When this document refers to "you," it means the individual Data Subject whose data is shared by the company, or the individual to whom J. Dauman Finance is providing services covered by this notice.

About Our Processing of Your Data

J. Dauman Finance collects, uses, stores, and transfers different kinds of personal data about you, grouped as follows:

  • Identity Data — names, usernames or similar; marital status; title; date of birth; sex and gender.
  • Contact Data — addresses, email addresses, and telephone numbers.
  • Financial Data — bank account details, tax information, National Insurance records, and related financial information about you and your company.
  • Transaction Data — information about payments and purchases made by you or your company.
  • Technical Data — IP addresses, login data, browser information, time zone, location, plug-ins, operating system, and other technology used to access this website.
  • Profile Data — usernames, passwords, security answers, feedback, and responses to our messages and enquiries.
  • Usage Data — analytics relating to how you use the website.
  • Marketing and Communications Data — your preferences about receiving communications from us or third parties.
  • Special Categories of Data — details about race or ethnic origin, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health, genetic, or biometric data.

We also collect Aggregated Data, such as statistical or demographic data. Aggregated Data may be derived from your personal data, but is not itself personal data, as it cannot be used to identify you. If Aggregated Data is ever combined with your personal data in a way that makes it identifiable, it will be treated in accordance with this notice.

What Happens If I Refuse to Provide My Personal Data?

It is necessary for J. Dauman Finance to process your data in order to fulfil its obligations to you or your company. If you choose not to provide the requested personal data, we will not be able to properly perform our contractual obligations. If we are already processing your personal data under a contract with you as an individual, you must end that contractual relationship (where permitted) to exercise certain rights. Our processing of your data also supports compliance with our regulators; failure to process it could result in legal and/or regulatory action from the relevant authority.

What Are Your Rights and Duties?

Your rights under Data Protection Legislation include:

  • The right to be informed of how your personal data is used (through this notice);
  • The right to access any personal data held about you;
  • The right to withdraw consent at any time, using the options provided in our communications;
  • The right to rectify any inaccurate or incomplete personal data held about you;
  • The right to erasure, where it cannot be justified that the information held satisfies the criteria outlined in this policy;
  • The right to prevent processing for direct marketing purposes, scientific/historical research, or in a way likely to cause substantial damage to you or another person, including through profile building; and
  • The right to object to processing that results in automated decision-making about you, and to prevent those decisions from being enacted.

You can exercise your right to access personal data by emailing office@jdauman.com with the subject line "Subject Access Request." You may need to confirm your identity. Responses are free of charge and provided within thirty (30) days, unless our Data Protection Officer deems the request excessive or unfounded — in which case we will inform you of any administrative costs and/or delays in advance, giving you the choice of whether to proceed. Who Is the Data Controller?

If we collected your data directly from you to provide services (e.g. bookkeeping, tax, accounting), we are the Data Controller.

If your data was passed to us by your company for processing under their instruction (e.g. for payroll), your company is the Data Controller. They should have informed you of this when they collected your data. See "Third Party Interests" below for a full list.

What Are the Lawful Bases for Processing Personal Data?

Under Article 6(1) of the GDPR, the lawful bases are:

What Are J. Dauman Finance's "Legitimate Interests"?

Legitimate interests are a flexible basis permitting the processing of personal data. We balance our needs and benefits against the risks and benefits to you, as objectively as possible, overseen by our Data Protection Officer. Profiling and Automated Decision-Making

J. Dauman Finance does not perform any profiling or automated decision-making based on your personal data.

How Long Will Your Data Be Kept?

We hold different categories of data for different periods and aim to minimise both the amount of data held and the time it's retained.

  • Data processed on the basis of "legitimate interests" is retained for as long as that purpose remains active.
  • Data essential for the performance of a contract is retained for six years, per the Limitations Act 1980, for the purposes of exercising or defending legal claims.

Who Can You Complain To?

We will acknowledge your complaint within 30 days and investigate without undue delay, informing you of the outcome and any action taken.

If you remain dissatisfied, or believe we have failed to comply with data protection legislation, you may complain to our supervisory authority. As J. Dauman Finance predominantly handles the personal data of UK data subjects, our supervisory authority is the Information Commissioner's Office (ICO). More information: ico.org.uk/concerns.
